Ian Lamont writes "The FCC has fined 11 retailers and television manufacturers for violating rules relating to the 2009 digital TV transition. Best Buy, Circuit City, Target, Sears, Kmart, and Wal-Mart supposedly failed to place notices near analog-only TV sets warning customers that the sets did not have digital tuners. In part, the required notice reads: 'This television receiver has only an analog broadcast tuner and will require a converter box after February 17, 2009, to receive over-the-air broadcasts with an antenna because of the Nation's transition to digital broadcasting. Analog-only TVs should continue to work as before with cable and satellite TV services, gaming consoles, VCRs, DVD players, and similar products.' The fines total $6.6 million."

Quantrell writes "A leaked e-mail shows that Apple hit the #1 spot for music sales in January. The article speculates that consumers cashing in their holiday gift cards may have played a role; but of course Wal-Mart and the other retailers sold gift cards too. The news is a mixed bag for the record labels. 'For the music industry, there is a dark side to Apple's ascension to the top of the charts. Buying patterns for digital downloads are different, as customers are far more likely to cherry pick a favorite track or two from an album than purchase the whole thing. In contrast, brick-and-mortar sales are predominantly high-margin CDs.'" We recently discussed Wal-Mart's role in the music business, back when they were selling nearly 20% of US music. For January Apple was at 19% and Wal-Mart at 15%.

Wal-Mart is the largest music retailer selling "an estimated one out of every five major-label albums" in the US. Wal-Mart willingly loses money selling CDs for less than $10 in order to draw customers into the store, but they are tired of taking a loss on CDs. The mega-retailer is telling the major record labels to lower the price of CDs or risk losing retail space to DVDs and video games. (Scroll to the bottom of the article for a breakdown of where exactly the money goes on a $15.99 album sale.) "[A Wal-Mart spokesman said:] 'The record industry needs to refine their business models, because the consumer is the ultimate arbitrator. And the consumer feels music isn't properly priced.' [While music executives are quoted:] 'While Wal-Mart represents nearly twenty percent of major-label music sales, music represents only about two percent of Wal-Mart's total sales. If they got out of selling music, it would mean nothing to them. This keeps me awake at night.' [And another:] 'Wal-Mart has no long-term care for an individual artist or marketing plan, unlike the specialty stores, which were a real business partner. At Wal-Mart, we're a commodity and have to fight for shelf space like Colgate fights for shelf space.'"

kamikasee writes "I recently found out that I'm going to be moved from an office to a cubicle. The cubicle area is not very secure, and I'm worried about things wandering off. My boss has offered to buy some equipment to help me secure things, but so far I haven't found anything that fits my requirements. Google and Amazon searches are overwhelmed by lockable key cabinets and larger pieces of furniture. Here are some of the requirements: The main issue with traditional solutions (e.g. locking things in a drawer) is convenience. I use a laptop with a second LCD monitor. There's also an external keyboard and mouse and a USB hard drive. I leave my laptop on at night so I can remote-desktop into it, so I'm not really happy about putting it in a drawer (no ventilation), plus I don't like the idea of having to 'unharness' everything every time I want to put it away. I don't trust cable locks. Besides, cable locks won't help me secure my the USB drive and other electronics that might wander off. The solution I imagine is a lockable, ventilated metal box that would sit under the monitor and house most of the electronics. If it was big enough, I could stick my laptop into it at night (while leaving it running) and feel confident that it would still be there in the morning. I'd be open to other types of solutions. Surely someone else must have dealt with this problem."

All this despite the systems repeatedly selling out. Multiple users have written to tell us that Toshiba is planning to halt production of devices related to HD-DVD. According to Japanese broadcasting network NHK, Toshiba will lose "hundreds of millions of dollars" as the format war finally draws to a close. Regardless, investors are pleased that Toshiba has made the decision to cut its losses. This comes after a last-ditch price cut was unable to prevent Wal-mart from throwing their lot in with Blu-ray, although some sources suggest that Wal-mart was already aware of Toshiba's plans to withdraw from fight.

Blue Light Special writes "With HD DVD on life support, Toshiba is reportedly preparing to bow to the inevitable and allow HD DVD to expire quietly. 'While denying that a decision on the fate of HD DVD has been made, a Toshiba marketing exec left the door wide open. "Given the market developments in the past month, Toshiba will continue to study the market impact and the value proposition for consumers, particularly in light of our recent price reductions on all HD DVD players," Jodi Sally, VP of marketing for Toshiba America Consumer Products, said.'" A few folks have also noted that Wal-mart is joining the Blu-ray train, further lowering the stock of HD DVD.
